Arbroath – A senior judge has effectively banned a vulnerable young woman from having sex on the grounds that she does not understand the risks involved. Mr Justice Hedley said the 29 year-old, who is autistic and has an IQ of 64, lacked the mental capacity to consent to having sex and so made the “very restrictive” order to protect her best interests. He said she had previously engaged in risky behaviour with a number of people because she did not understand she could say no, and that she should be protected from “potentially exploitative and damaging” relations in future. The order not only means she is prevented from having sex, but also means anyone who tried to have intercourse with her could be charged with sexual assault or rape. … The judge concluded that H lacked capacity to consent to sex as “she does not understand the health implications” and “cannot deploy the information she has effectively into the decision-making process”.

Hey, I’m all for the protection of people with disabilities — I’ve never once called for the banning of anyone from my comment section. I understand the struggles slow, retarded, or autistic people have in the cold, fast reality we live in today. But I’m also a believer in freedom. Freedom of speech, freedom of religion, freedom of sex. These are things that make life worth living. This chick can’t have sex because she scored low on one of your “IQ” tests? Bet you didn’t think Forrest Gump could be a college football All-American war hero who started a multi-million dollar shrimping company, either.

What’s next, England? You gonna ban people from voting because they don’t understand the dangers of who they’re voting for? You gonna ban people from listening to music because their friends talked them into liking Nickelback? You gonna ban people from eating breakfast because they don’t understand the implications of how delicious grits can be? I don’t care if these analogies don’t make any sense. FREEDOM DOESN’T MAKE ANY SENSE.

Stop telling people what they can and can’t do. There are 12 year-olds who’ve never heard the phrase “STD” in their lives freely getting knocked up all over the world right this moment — your case is flawed.  Get this dim broad a chaperone, a lo-jack, and a box of rubbers and let freedom ring.
